Terms.
This page sets the conditions under which you may use markonwalls.com and the tools provided on it (the Wall Visualizer, sample-box requests, and inquiry forms). It is not a substitute for the proposal, contract, and warranty that govern a specific commissioned project — those are agreed in writing on a per-engagement basis.
1 · Acceptance
By using this site you accept these terms. If you do not accept them, please don’t use the site. We may update these terms from time to time; the effective date above will change accordingly.
2 · Use of the site
- You may browse the site, request samples, submit inquiries, and use the Wall Visualizer for personal and professional design exploration.
- You may not scrape the site for mass reproduction, train machine-learning models on the photography without written permission, attempt to circumvent any access control, or use the site to transmit unlawful, harassing, or infringing material.
- The site is offered as-is, subject to scheduled maintenance and the realities of small-studio operations.
3 · Trademark and brand
MarkOn® is a registered trademark of the studio. The wordmark, logotype, brand colors, typography system, and the trade dress of this site are owned by MarkOn® Walls. None of those elements may be reproduced, used as the basis for derivative work, applied to other products or services, or referenced in a way that suggests sponsorship or affiliation, without prior written permission. Fair editorial reference (citing the studio by name in a publication, for example) is welcomed.
4 · Photography and project imagery
Project photographs on this site depict MarkOn® Walls installations. The studio owns or has secured rights to those images for the use shown here. Re-publication — whether editorial, commercial, or social — requires written permission. Clients photographed in their own spaces have given their consent to the use shown on this site only.
If you are press or a publication considering coverage, please write to press@markonwalls.com for credentialed imagery and signed releases.
5 · Wall Visualizer
The Wall Visualizer is provided as a complimentary design exploration tool. It is not a finish-rendering engine. Renderings produced are approximations only — actual installed plaster will vary based on substrate, lighting, the day’s humidity, pigmentation, and the hand of the craftsperson. Decisions about specification should be made from physical samples reviewed in your space, not from on-screen previews.
Images you upload to the Visualizer are processed entirely in your browser. They are not transmitted to our servers, stored, or visible to anyone at the studio.
6 · Inquiries and engagement
- Submitting an inquiry does not create a binding agreement; it begins a conversation.
- Specific terms for a commissioned project — scope, pricing, schedule, surface preparation, on-site conditions, change orders, payment terms, and warranty — are agreed in a separate written proposal between MarkOn® Walls and the client.
- Lead times posted on the site are typical; actual lead time depends on studio availability, material lead time, and scope.
- The studio operates by invitation. We reserve the right to decline or step back from a project that is not a good fit.
7 · Sample boxes and material samples
Sample boxes are provided as physical references at the studio’s discretion, generally without charge to qualifying trade. Samples are color and texture indications only; the final installed finish on a specific wall, substrate, and light condition will differ. Samples remain the property of the studio unless explicitly gifted.
8 · No warranty (site)
The site and the Wall Visualizer are provided “as is” and “as available,” without warranty of any kind, express or implied, including fitness for a particular purpose. Project warranties are separate and are set in the commissioned-project contract.
9 · Limitation of liability
To the maximum extent permitted by law, MarkOn® Walls is not liable for indirect, incidental, special, consequential, or punitive damages arising out of use of the site, the Wall Visualizer, or other materials made available here. The studio’s aggregate liability for any claim arising out of use of the site is limited to the amount you paid the studio for use of the site (typically zero, as the site is free to browse).
10 · Third-party links
The site may link to external resources (architects, publications, suppliers). Those sites are not under our control and we are not responsible for their content, policies, or accuracy.
11 · Termination
We may suspend or terminate access to the site or specific tools at any time, including in response to misuse or abuse. These terms survive termination to the extent needed to enforce them.
12 · Governing law and venue
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms shall be brought in the state or federal courts located in New York County, New York, and both parties consent to that jurisdiction.
13 · Severability and entire agreement
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full effect. These terms, together with any separate written proposal or contract for a commissioned project, are the entire agreement between you and MarkOn® Walls regarding the site.
